Article 1
Creation

The training courses provided by InnovEmployment – Knowledge Management, Single-Member Ltd., hereinafter referred to as INNOVEMPLOYMENT, are created by the Training Team, consisting of Trainers, Coordinators, and Managers, and may result from Collaboration Protocols entered into between INNOVEMPLOYMENT and other entities.

Article 2
Objective

The training courses provided by InnovEmployment aim to deliver the theoretical and practical preparation required to train specialized technicians to perform the roles for which they are acquiring specific knowledge.

Article 3
Publicizing the Training Offer

All InnovEmployment training initiatives may be publicized through the following channels: media, newsletters; Internet pages; partners, direct contact at the premises, and presentations at companies.

Article 4
Schedule, venue, and timetable of the Training Offer

  1. The training courses are held at InnovEmployment’s premises, located at Rua Julieta Ferrão, no. 12, 204, 1600-131 Lisbon, or at other locations designated by it.
  2. The preparation of the schedule for each training course is the responsibility of the Pedagogical Coordination and Management.
  3. It is the obligation of the entire team of trainers to follow the defined schedule, fully respecting the training hours and breaks set therein.
  4. The dates and times of the training courses are announced through InnovEmployment’s various media and communication channels and are confirmed at the time of registration.
  5. Changes may occur to the date and venue of the training course. When this happens, the changes will be communicated to trainees and trainers by phone and email as soon as possible.
  6. For operational reasons or factors beyond the organization’s control, InnovEmployment reserves the right to make occasional adjustments to the dates, times, and venues of the course, with trainees being informed of the change as far in advance as possible.

Article 5
Operating conditions

  1. Setting the calendar and schedule for the training courses is the responsibility of InnovEmployment.
  2. Each training course has its own schedule, which must be respected by trainees and trainers.
  3. The date, time, and venue of the training must be kept permanently up to date and available for consultation in Promotional Flyers, as well as on INNOVEMPLOYMENT’s website, and are confirmed to trainees upon receipt and validation of their registration.

Article 6
Attendance conditions

  1. The training courses promoted by InnovEmployment are intended for all active individuals (employed or unemployed) who wish to refresh and/or improve their knowledge, provided they fit the profile defined for each training course.
  2. Participation in the training course is confirmed after receipt of the Registration Form/ Training Contract, duly signed, together with proof of payment of the full amount of the training course.

Article 7
Candidate registration

  1. Trainees register to attend a training course by completing and sending, via email, to InnovEmployment, the Registration Form/Training Contract and proof of payment of the full amount of the training course.
  2. The minimum and maximum number of trainees admitted per training course is defined by InnovEmployment.
  3. If the registration is accepted, trainees will receive an email confirming their registration, including the schedule, training timetable, address of the venue, training regulations, and any other information deemed relevant for attending the course.
  4. Three days prior to the date of the training course, a reminder email will be sent to trainees regarding their participation.
  5. If the number of registrants exceeds the maximum limit set for each training course, and if justified, InnovEmployment may schedule and run a new edition as soon as possible.

Article 8
Candidate selection

  1. The selection of trainees is the responsibility of InnovEmployment’s Pedagogical Coordination and is carried out according to the criteria defined for each training course.
  2. The number of participants per course is limited; therefore, selection is made in order of receipt of registrations and based on the professional profile defined for the training course. Exceptionally, trainees who do not fully match this profile may be accepted, subject to a curricular assessment by the Training Manager, in collaboration with the Coordinators.

Article 9
Payment terms and refund policy

  1. The fee payable for registration in each training course is set by InnovEmployment and is available in Promotional Brochures and on the website.
  2. This fee must be paid in full and prior to the start of the training course.
  3. Payment is made, by the participant or the employer, via bank transfer, according to the following details:

  1. After confirmation of receipt of payment, InnovEmployment issues the corresponding Invoice/Receipt.
  2. The registration fee includes participation in the training course, coffee breaks, where applicable, all supporting documentation, and the Certificate of Participation or Professional Training.
  3. If the training course does not take place on the scheduled date or is canceled for reasons not attributable to trainees, they are entitled to a refund of the amount paid or to retain credit for future participation, if another date is already scheduled.
  4. When, due to a serious accident or illness duly substantiated, trainees are unable to continue attending the training course, InnovEmployment will allow them to attend one of the courses taking place in the following months or the next course to start, with trainees paying only a 15% fee for administrative expenses related to their reintegration.
  5. InnovEmployment may, at any time, decide to apply reductions resulting from possible promotions, seasonality, etc., and will disseminate these through its communication channels.

Article 10
Interruption, cancellation, or withdrawal

  1. InnovEmployment reserves the right to cancel the training session, with a minimum notice of three business days prior to its commencement, if the minimum number of participants is not met or for any other justified reason.
  2. The cancellation of the training session is communicated to all registered participants via phone contact and e-mail.
  3. Cancellations of registrations are accepted up to seven days before the scheduled date of the training session. Cancellations submitted thereafter will result in the retention of 20% of the registration fee to cover administrative costs.
  4. Notification of withdrawal by participants after the commencement of the training session does not obligate InnovEmployment to refund the paid amounts.
  5. For the registration of employees by companies, if the registered employees/trainees cannot attend, the client company may replace them with others, provided InnovEmployment is informed.

Article 11
Attendance, punctuality, and absence policy

  1. Attendance at the training course is mandatory for in-person courses.
  2. Trainees must be regular and punctual and comply with the schedules set for the delivery of the training.
  3. In all training sessions, attendance sheets will be provided by the trainer, on which trainees must sign in order to monitor attendance.

Article 12
Assessment

  1. InnovEmployment may carry out the following types of Assessment:
  2. Diagnostic Assessment, aimed at identifying candidates’ initial knowledge and verifying the existence of the requirements stipulated for attending each training course, or to better form groups in line with the stated objectives. This assessment may also serve to determine whether the candidate has mastered fundamental knowledge, particularly in scientific areas, with a view to directing them to attend a prior formative integration unit or to alert trainers to the group’s weaknesses when teaching modules based on that knowledge.
  3. Reaction Assessment, aimed at identifying positive and negative aspects of the training’s operation, including satisfaction, and contributing to the continuous improvement of the training courses developed by InnovEmployment.
  4. Assessment of trainees’ Learning, which will be conducted within each training unit, and should result in a qualitative and/or quantitative assessment, depending on what was defined in its design.
  5. Trainers must also complete a Report to evaluate trainees’ participation/progress during the training process, where applicable, and on the development of the course itself.

Article 13
Trainees’ rights and duties

  1. Trainees are entitled to:
  2. Receive the training for which they registered, in accordance with the defined programs, methodologies, and work processes;
  3. Receive the training support materials provided for each type of course;
  4. Use the facilities and support services during the training;
  5. Receive, at the end of the training course and after settlement of the applicable amounts, a training/attendance certificate (according to demonstrated attendance and achievement);
  6. Turn to the training coordination whenever necessary;
  7. Refuse to carry out activities that are not within the scope of the training course;
  8. Have the First Party ensure and enforce compliance with the Occupational Health and Safety conditions it is legally required to observe.
  9. Trainees have the duty to:
  10. Attend the training course regularly and punctually, with the aim of acquiring the theoretical and practical knowledge delivered, in compliance with the current Training Activity Operating Regulations;
  11. Participate actively in the training;
  12. Sit any knowledge assessments to which they are subject;
  13. Answer the training evaluation questionnaires honestly;
  14. Respect fellow trainees, the trainer, and all other participants in the training process;
  15. Remain loyal to InnovEmployment, namely by not disclosing to third parties any confidential information that comes to their knowledge during the training course;
  16. Use with care and ensure the proper maintenance of equipment and other assets entrusted to them for training purposes;
  17. Respect the operating rules of the venue where the Course takes place;
  18. Bear the costs of replacing or repairing equipment and materials used during the fast-track training period, supplied by the First Party and its representatives, whenever the damage results from willful misconduct or gross negligence;
  19. Comply with these regulations and the terms of the contract.
  20. Failure to comply with these duties grants InnovEmployment the right to terminate the training contract, immediately extinguishing all rights arising therefrom.

Article 14
Main responsibilities of the trainer

  1. Trainers’ responsibilities include:
  2. Complying with the operating schedule established for each training course;
  3. Delivering the planned syllabus for each training course;
  4. Contributing to trainees’ development by fostering the enhancement of their skills;
  5. Clarifying trainees’ doubts regarding the subject matter of the training course;
  6. Requesting that all trainees complete the Reaction/Satisfaction Assessment Questionnaire;
  7. Completing the Attendance Sheet, Summary and Incidents, and Trainer’s Report;
  8. Ensuring the preservation of the material and technical resources placed at their disposal.

Article 15
Main duties of the technical team

  1. The Technical Team has the duty to:
    a) Prepare the training room in logistical terms and install the IT equipment to be used in the training course;
    b) Distribute all supporting documentation (manuals, notebooks, and pens), water, etc., according to the seating allocation for trainees;
    c) Be available to answer any questions from trainees regarding the organization of the training course;
    d) Be informed about all aspects inherent to the training course, ensuring intervention whenever necessary;
    e) Collect all documents completed by the trainer and trainees;
    f) Hand deliver Certificates of Participation to trainees.

Article 16
Certificate

  1. Trainees will be entitled to a free Professional Training Certificate/ Certificate of Attendance upon completion of the training course.
  2. To be eligible to obtain the Certificate of Participation in the training course, trainees must have a minimum attendance of 75% of the total training hours.
  3. Trainees attending training courses that include knowledge assessment and who successfully complete them will be issued a Professional Training Certificate through the SIGO platform, in accordance with Ordinance no. 474/2010 of 8 July, as currently worded.
  4. Trainees who do not achieve a pass may receive a Statement of Attendance in Professional Training, which must be requested in writing from the Pedagogical Coordination.
  5. Certificates will be issued in accordance with the regulatory framework, namely Decree-Law no. 396/2007 of 31 December and Ordinance 474/2010 of 8 July.

Article 17
Complaint and grievance management

  1. All documents submitted by trainees, trainers, or other stakeholders in the training process that set out a specific situation reporting procedures, conduct, logistical or material conditions that jeopardize learning or offend the dignity and rights of those involved in the training process are considered incidents and/or complaints.
  2. These situations must be communicated in writing via email – geral@innovemployment.pt – within a maximum of 5 days after the incident.
  3. Depending on their nature, all submitted situations will be handled by InnovEmployment Management, which must provide the complainant with a response within 5 days of receipt of the incident and/or complaint, informing them of how the situation was addressed.
  4. InnovEmployment provides a complaints book.

Article 18
Processing of personal data and data protection

  1. The personal data contained in the Registration Form/ Training Contract or other training-related documents will be processed electronically by InnovEmployment, ensuring their strict confidentiality.
  2. InnovEmployment ensures the lawful, secure, and confidential processing of the data collected and undertakes to implement appropriate and necessary measures to protect and prevent improper and unauthorized access, destruction, alteration, and dissemination and/or any other form of unlawful processing, as provided for in the declaration annexed to the employment contract and the training contract, which form an integral part thereof.
