2. Duty to Inform

Law No. 58/2019 of 8 August, hereinafter “LPDP”, and the General Data Protection Regulation (Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, hereinafter “GDPR”), ensure the protection of natural persons with regard to the processing of personal data and the free movement of such data. “Personal data” means any information, of any nature and regardless of its medium, including sound and image, relating to an identified or identifiable natural person; therefore, protection does not cover data of legal persons. An identifiable person is one who can be identified, directly or indirectly, in particular by reference to an identification number or to one or more specific elements of their physical, physiological, psychological, economic, cultural or social identity (for example, their name associated with their telephone number or email address).

3. Purpose of Processing Personal Data

The personal data we process through the website identified above will only be used for the following purposes:

a) managing the contracting of services carried out through the Website, such as scheduling meetings and requesting contact;

b) periodically sending our electronic bulletins – newsletters – with news related to Innovemployment’s activity and to the sector in which it operates;

c) managing applications submitted for recruitment processes, including analysis of the Curriculum Vitae and Cover Letter;

d) periodically sending commercial and/or promotional information related to the contracted services sector, unless the data subject objects or withdraws consent;

e) anonymous and aggregated analysis of service usage to identify user habits and trends, in order to improve the services offered and meet users’ specific needs;

f) in the event of hiring, the data collected on this Website, together with other data obtained within the scope of the contractual relationship, will be used for human resources management, to ensure compliance with legal obligations, and to provide employees with the means necessary to carry out their professional activity;

g) compliance with national and international legal provisions, or execution of an order from the competent judicial authorities;

h) compliance with legal obligations arising from applicable data protection legislation, as well as exercising data subjects’ rights, in particular the defense of a right in legal proceedings.

Innovemployment guarantees the confidentiality of all data provided. Although Innovemployment collects and processes data securely, preventing its loss or manipulation by using the most appropriate techniques for this purpose, it should be noted that data collection on open networks allows personal data to circulate without absolute security conditions, with the risk of being seen and used by unauthorized third parties.

Failure to provide data marked as mandatory makes it impossible to respond to the data subject’s request.

 

4. Lawful Basis for Processing Personal Data

Innovemployment processes Users’ data:

a) when they give their explicit and freely given consent for the processing of their personal data for specific purposes and/or,

b) when necessary for the performance of a contract to which the user is a party, or for pre-contractual steps at the user’s request;

c) to comply with legal obligations to which Innovemployment is subject;

d) for the purposes of the legitimate interests pursued by Innovemployment or by third parties, except where overridden by the interests or fundamental rights and freedoms of the data subject which require the protection of personal data.

The User warrants that the information provided is true, accurate, complete and up to date, and is responsible for any damage or loss, direct or indirect, that may be caused as a result of breaching this obligation.

If the data provided belongs to a third party, the User warrants that they have informed the third party of the aspects set out in this document and obtained their authorization to provide their data to Innovemployment for the purposes indicated.

 

5. Retention Period

Innovemployment only retains and processes your personal data for the period necessary or required to fulfill the purposes described above, applying information retention criteria appropriate to each processing activity and in line with applicable legal and regulatory obligations.

Innovemployment keeps personal data in its systems in such a way that it is possible to identify data subjects according to the following criteria:

a) for a period not exceeding the pursuit of the purposes for which it was collected, unless legal or contractual obligations provide otherwise;

b) to comply with specific legal or contractual obligations;

c) where applicable and lawful, until a possible objection or erasure request by the Data Subject.

 

6. Data Disclosure

In addition to disclosures made in compliance with legal obligations, the Data Subject’s personal data may be accessed, besides Innovemployment, by:

a) Innovemployment’s employees and staff, in their capacity as authorized data processors;

b) national and international companies belonging to the same group as Innovemployment;

c) authorities in general, administrations, entities and public bodies, both national and international;

d) external service providers;

Exclusively for the purposes indicated above, in accordance with the consents granted by the Data Subject.

 

7. International Data Transfers

The personal data collected will be processed within the European Economic Area; there are no international data transfers to third countries or international organizations.

If personal data is processed outside the European Economic Area, this will only occur with the adoption of appropriate safeguards and the required level of protection, in accordance with personal data protection laws.

 

8. Information Security

Innovemployment has implemented appropriate technical and organizational security measures to ensure the security of the personal data provided by the User, aiming to prevent its alteration, loss, processing and/or unauthorized access, taking into account the state of the art, the nature of the data stored and the risks to which it is exposed.

Personal data is processed with the level of protection required by law to ensure its security and prevent alteration, loss, processing or unauthorized access, taking into account the state of technology, with the user being aware and accepting that security measures on the Internet are not impregnable.

Whenever Innovemployment accesses personal data, it undertakes to:

a) store it by means of legally required technical and organizational security measures that ensure its security, thereby preventing alteration, loss, processing or unauthorized access, in accordance with the state of technology at each moment, the nature of the data and the possible risks to which it may be exposed;

b) use the data exclusively for the previously defined purposes;

c) implement physical security measures to protect the facilities;

d) ensure that the data is processed solely by staff whose involvement is necessary to fulfill the data subject’s request, who are bound by duties of secrecy and confidentiality. If it is possible that information will be disclosed to third parties for the aforementioned purposes, they must be required to maintain appropriate confidentiality in accordance with this document.

If Innovemployment subcontracts other entities to provide services involving the transfer of personal data, those entities will be required to adopt the necessary technical and organizational measures to protect personal data against destruction, loss, alteration, disclosure, unauthorized access or any other kind of unlawful processing.

10. Supervisory Authority

The User also has the right to lodge a complaint with the Portuguese Data Protection Authority (CNPD) regarding matters related to the exercise of their rights and the protection of their personal data, via the following website www.cnpd.pt.

However, Innovemployment does not control the content or links that appear on those pages and is not responsible for the practices used by those pages or websites. Innovemployment advises users to visit the privacy policy of such pages as well as their terms and conditions.
